The simplest scenario is where data subject, the terms of membership
agreement and the manager of the database are in the same jurisdiction.
The most complex is where they are each in separate jurisdictions.
That would be the most complex until you realise that chapters have
their own terms, jurisdiction and data manager needs. Then consider ISOC
requires chapters to manage the members who sign up directly at ISOC and
also tick the chapter box. Clearly there is a potential for multiple
conflicts from this matrix of possible responsibilities.
A further complication I've seen from ISOC staff has been that all
chapter members must be ISOC members. That has caused some contortions
on this list. I think this requirement is a bit of a remnant from the
time when ISOC had members. It should now be enough for all subscribers
whether recruited via the internetsociety.org site or via a chapter to
sign up to an agreed mission that is shared throughout the ISOC
community and be on an email list.
Maybe it is time for a general principle? I recommend this community
should eat its own policy dog food and deploy services that really do
put the user in control. I'll declare an interest. I'm involved with a
new Community Internet Company in the UK which is deploying services
with that in mind. I'm more than happy to advise, build or otherwise
assist dotting the i's etc to explore the options.
