Dear All,

I am just replying Ted Hardie & Dave Burstein, to not loose the thread of the discussion.

… previously ... Ted kindly reply in another email to my comment,

L Martinez ->
"in addition to the secrecy of some email-lists is to be kept."

T. Hardie ->
“ Again, this is not quite correct.  The board's understanding of this situation is that the list was closed by the decision of the relevant community, and it is our view that they can decide to open it again without requiring board approval or action.  Since the message from the ChAC was a request to the board to open it, it seems likely that they will do so now that it is clear that they do not require board action, but it is up to the ChAC to decide the matter. "

Actually I agree on Ted and Dave’s view on the subject. I mistakenly mixed issues in my previous.

There is no board action there, as I said previously it is a overseeing body. Members are expected to give guidance and take care of our most deep values. Regarding email lists, my view is that any email contents remain property of the one who wrote them and the recipients (as they were allowed to read them). If they decide that has to be shared on the email system it still needs the email platform owners’ consent (by a number of provisions taken in any system to protect privacy and confidentiality). It is a private communication unless it is an open platform. Of course, any telecom lawyer may provide advice to my engineer’s view.

Thanks Ted for the extended explanation on the issue, I am sure that Chapters’ members share my gratitude to your email while not hearing ChAC communication recently.

Best Regards,
Luis *
