One thing I like about this story is the way it draws attention to the FCC decision to entirely disregard the Berkman report - which points out how mandatory line-sharing has led to cheaper and faster service in other countries. 
I asked about this at the National Broadband Plan review at New York Law School earlier in the year, and was told it was flatly rebuffed on the grounds that the economics didn't add up. http://www.isoc-ny.org/p2/?p=740
