The legal message is there to protect us, and everyone on the lists, from legal action related to violating this very item in the code of conduct.

The code of conduct is intended to establish what is _polite_ to do, not what is _legal_ to do.  I don't believe there is a contradiction here at all: in most places, it turns out, being rude is not against the law.
