Dear Gonzalo,

It looks like we might wind up reproducing on this list the discussions that
we had on the Internet Policy list and that are summarized in the document
that the Chapters Advisory Council is reviewing.

Regarding the reasons for confidentiality, as I recall, the main reason
given was that Ethos requested it. In my view, ISOC should not have accepted
such stringent non-disclosure requirements, even if that meant that Ethos
would have withdrawen its offer.

The reason being that lack of transparency leads to lack of trust and
suspicion. That's one of the reasons for the criticism of the deal, and one
of the reasons why the California Attorney General has decided to get
involved formally. In my view, it was predictable that lack of transparency
would cause problems. Further, in my view, it is contrary to the principles
that ISOC has long advocated.

confidentiality requirements on some of the data.

It's pretty obvious that all public information will indeed be public and
therefore we will have access to it. What someone may find disturbing is
that instead of getting first-hand information as stakeholders would have
expected, we will probably get most of the key information from public
sources thanks to a Department of Justice investigation...
