That comment by Viviane Reding is ridiculous. There is literally no law or directive or whatnot that the EU can pass within its current mandate that would affect the US ability to spy on us. The EU cannot even legislate the spy programs of its own member states: fundamental EU treaties make a specific exception for national security measures.

The legal aspect of this was analyzed in a 2001 European Parliament report, starting in chapter 7:
