[Chapter-delegates] TikTok and related US actions

Dear folks on the Chapter Delegates list:
I'm writing here to let those of you who don't already know that I'm one of
the lawyers working on the lawsuit filed last week on behalf of TikTok
employees. (This lawsuit is separate and analytically distinct from the
lawsuit TikTok Inc. and Bytedance have filed.)
I wanted to share this with you because some of you will see my name in
association with the TikTok litigation and may wonder if it relates to my
work as an ISOC trustee; I consulted with Andrew Sullivan and Ilona Levine
(our new general counsel) last week just to clear how best to share this
information with you. Mainly we want you to know that my efforts and public
comments on the TikTok cases reflect my opinion as a working lawyer and
public-policy specialist, and not my position as an ISOC trustee. At the
same time, we do not anticipate that my work on behalf of TikTok employees
will be in conflict with anything I'm doing as an ISOC trustee, although we
will continue to be alert to possible conflicts.
I want to say broadly that I share your concerns about the TikTok executive
orders (which also affect WeChat), as well as your concerns about the Clean
Network initiative, which Richard Hill and others discussed a bit upthread.
If you're interested in what I and other members of our legal team are
doing in the TikTok employee-focused case, please feel free to contact me
directly, and I can answer more questions in private email.
