Definitely could become a case of the Streisand effect!
It is, however, bad journalism, poor taste, offensive to the young women
and they should be called out over it.
My understanding is that in Australia it would be dealt with by
professional codes of conduct. That is for print journalism.
I can understand the school wanting to sue for loss of reputation. The
poor young women involved must be feeling horribly degraded by these
ridiculous assertions. The journalists should be rebuked for it, and their
editors should know better!
But jail? No.
Over here, I would suspect in this case they would be forced to write a
retraction and the apology should have equal space as the original
article. This would be on the basis of the harm and suffering caused.
Radio and television is different, however. They can be fined or lose a
broadcasting license for offensive behaviour. The relevant codes and a
case are listed below. ACMA is the Australian Communications and Media
Authority.
ACMA finds 2DAYs Kyle & Jackie O Show breached decency
MR 16-2012 27 March ACMA finds Sandilands comments deeply derogatory
and offensive.
Kyle Sandilands comments about a female journalist were deeply derogatory
and offensive, and amounted to a breach of the Commercial Radio Codes of
Practice 2011 (the codes), the Australian Communications and Media
Authority (the ACMA) has found.
The ACMA has begun formal steps to impose a second licence condition on
broadcaster 2DAY FM Sydney which would prohibit the radio station from
broadcasting indecent content and content that demeans women or girls.
The ACMA action follows an investigation into a segment broadcast on the
Kyle & Jackie O Show on 22 November 2011.
The Authority found the comments by Mr Sandilands deeply derogatory and
offensive and, in all the circumstances, a licence condition is the
appropriate response, said ACMA Chairman, Chris Chapman.
