Dear All,

I am just replying Ted Hardie & Dave Burstein, to not loose the thread of the discussion.

… previously ... Ted kindly reply in another email to my comment,
"in addition to the secrecy of some email-lists is to be kept."
T. Hardie ->
“ Again, this is not quite correct. The board's understanding of this situation is that the list was closed by the decision of the relevant community, and it is our view that they can decide to open it again without requiring board approval or action. Since the message from the ChAC was a request to the board to open it, it seems likely that they will do so now that it is clear that they do not require board action, but it is up to the ChAC to decide the matter. "

Actually I agree on Ted and Dave’s view on the subject. I mistakenly mixed issues in my previous.

There is no board action there, as I said previously it is a overseeing body. Members are expected to give guidance and take care of our most deep values. Regarding email lists, my view is that any email contents remain property of the one who wrote them and the recipients (as they were allowed to read them). If they decide that has to be shared on the email system it still needs the email platform owners’ consent (by a number of provisions taken in any system to protect privacy and confidentiality). It is a private communication unless it is an open platform. Of course, any telecom lawyer may provide advice to my engineer’s view.

Thanks Ted for the extended explanation on the issue, I am sure that Chapters’ members share my gratitude to your email while not hearing ChAC communication recently.

Best Regards,
According to what we found, the list was originally created in 2005 to enable then-current Internet Society Chapter leaders to get information relevant to their Chapter, to their leadership positions and as a place for them to discuss and share issues pertinent to the Internet Society Chapter community. The archive was private to list members on its creation, but it was made open in 2009 for reasons which are not recorded. When that was noted in 2020, the open nature of the archives was a surprise to folks on the list, and the archives were limited again. Christine Saegesser then issued a poll (see https://elists.isoc.org/mailman/private/chapter-delegates/2020-July/022153.html) to assess the preference of the community for open or closed archives. Apparently only 30 of the about 800 or so people eligible to respond took the opportunity to do so, and of those 20 recommended the archives be closed and the list restricted to current leaders. That's the decision that was implemented.

If the ChAC wants to make this change it can use its own procedures to make the new decision and then request the staff to update the list if desired. Your staff contacts will be able to discuss the alternatives with you, Note that there will be some administrative overhead in making any related change.
